(CIT) – 2020

Companies that are legal persons are required to settle accounts with the tax office using the so-called CIT

Corporate tax issues are governed by:

Chapter 5 of the Corporate Income Tax Act of February 15, 1992.

The applicable corporate income tax rates in 2020

19% tax base on general principles

9% of the tax base in the case of small taxpayers and taxpayers starting their business – in the tax year in which they started operating (except for taxpayers listed in Article 19 paragraph 1a of the Act and tax capital groups)

19% on dividends and other revenues from share in profits of legal persons having their registered office or management in the territory of the Republic of Poland

19% on the revenues of a foreign controlled company obtained by a taxpayer having its registered office or management in the territory of the Republic of Poland

The situation is different for persons of entities that do not have their headquarters or management on the territory of the Republic of Poland. In their case, income tax on revenues obtained on the territory of the Republic of Poland is different

Income tax on revenues earned on the territory of the Republic of Poland by entities that do not have a registered office or management board in the territory of the Republic of Poland is:

1) from interest, from copyright or related rights, from rights to inventive projects, trademarks and decorative designs, including the sale of these rights, from payment for disclosing the secret of a recipe or production process, for use or the right to use an industrial device , including means of transport, commercial or scientific equipment, for information related to experience in the industrial, commercial or scientific field (know-how),

Note: To the above revenues from p. 1, the tax exemption referred to in art. 21 paragraph 3 of the Corporate Income Tax Act.

2) from fees for services in the field of entertainment, entertainment or sport, performed by legal entities established abroad, organized through natural persons or legal entities conducting activities in the field of artistic, entertainment or sports events in the territory of the Republic of Poland,

3) for services: consultancy, accounting, market research, legal services, advertising services, management and control, data processing, employee recruitment and recruitment services, guarantees and sureties, and similar services

1) due to fees due for the export of cargo and passengers accepted for carriage in Polish ports by foreign commercial shipping companies, with the exception of cargo and transit passengers,

2) obtained on the territory of the Republic of Poland by foreign air navigation companies.

These rates may be modified by the provisions of the relevant double taxation agreement.
